2008 REDEVELOPMENT LAW INSTITUTE: The Impact of Gallenthin v. Paulsboro & other Recent Decisions

This year has been a challenging one for redevelopment in New Jersey. Judicial decisions and Legislative and Regulatory proposals have all combined to make it more difficult for municipalities to achieve the redevelopment goals envisioned in the State Development and Redevelopment Plan. Learn about such developments from experts in the field at the annual Redevelopment Law Institute. Attendees can expect insightful discussions on the following cutting-edge topics:

• The Supreme Court’s decision in Gallenthin v. Paulsboro, and related decisions announced since Gallenthin, have chilled many municipalities’ willingness to use eminent domain, or even to proceed with redevelopment at all. What do the cases hold, and how will Gallenthin continue to impact redevelopment.

• New NJDEP regulations and changes in policy will impact many urban and older suburban areas, including those with proposed projects along waterways where such municipalities are located, as well as brownfields projects. How will these changes impact redevelopment projects and what are the economic and financial implications?

• New COAH regulations are anticipated soon. If they continue to impose a “growth share” obligations on redevelopment projects, they will continue to burden what are often economically challenging projects. On the other hand, with appropriate financing sources, redevelopment may represent an option to achieve new affordable housing in New Jersey where scarce resources limit ability to develop such housing.

Weeden v. Trenton determined that variances can be granted from redevelopment plans. It is one of several cases where the competing land use and redevelopment objectives have been balanced by the Courts.

• Legislative proposals to revamp the redevelopment statutes would impact the tools used for redevelopment. An update on the status of legislation will be included as part of the seminar.

As redevelopment continues to be relied upon as a way to accomplish the rejuvenation of the older urban and exurban municipalities of our State, this timely conference will go beyond the basics of redevelopment law, and focus on some of the other legal issues and challenges that have become the focus of practitioners and their clients in New Jersey. Authoritative panels will provide informative presentations and insightful commentary regarding some of the most current issues of interest to attorneys in a variety of specialized areas of law.
